Report of Joint Inquiry into Complaints Filed Against Gainesville City Manager Forwarded to the City Commission

Pursuant to the City’s Equal Opportunity Policy (EO-8), City Auditor Carlos L. Holt and City Equal Opportunity Director Torey Alston have submitted written reports of fact-finding and review of the complaints filed by Evelyn Foxx of the NAACP Alachua County Branch and Cheryl McBride regarding City Manager Anthony Lyons. The reports were received by the City Commission Wednesday, Oct. 11, 2017.

The City Auditor is a certified CPA, and has investigative expertise in the areas of alleged fraud, waste and abuse, but is not trained in equal opportunity issues. The Equal Opportunity Director is experienced in areas involving equal opportunity issues, hiring policies and procedures and procurement issues. As a result, the following methodology has been used to preserve the integrity of the reporting process. The report is outlined in two parts: Part I and Part II.

Part I of the report addresses allegations related to “A” (human resource policies and procedures) and “B” (procurement policies and procedures). Both City Auditor Holt and Equal Opportunity Director Alston conducted the inquiry, interviewed individuals and obtained evidence to be considered. Both Holt and Alston jointly agree on conclusions and the elements of Part I of the report.

Part II of the report addresses allegations regarding “C” (pay equity) and “D” (retaliation, harassment and hostile work environment). Again, both City Auditor Holt and Equal Opportunity Director Alston conducted the inquiry, interviewed individuals and obtained evidence to be considered; however, only the Equal Opportunity Director was involved in forming conclusions and approving the elements of Part II of the report.

Legal review of the report was also coordinated through the City Attorney’s Office. The City Manager has had opportunity to review the report and provide a response.
