The Gainesville Land Development Code requires mitigation for each regulated tree removed. The size (diameter), species, and condition of the tree, as well as the land use and where on the property the tree is located, will determine the mitigation. Mitigation trees must be nursery-grown, 2” ±0.5” in diameter, and Florida Nursery Grade #1. Please see “Sec. 30-8.7” Permits for Tree Removal; Mitigation” for more details. The “Gainesville Tree List” provides the species that are approved for mitigation and is available upon request.
Important: Effective July 1st, 2019, HB1159 (F.S. 163.045) prohibits local governments from requiring "a notice, application, approval, permit, fee, or mitigation for the pruning, trimming, or removal of a tree on residential property if the property owner obtains documentation from an arborist certified by the International Society of Arboriculture or a Florida licensed landscape architect that the tree presents a danger to persons or property." If you have questions about this new statute, please call our office to avoid any potential violations of the city's Land Development Code or this new state statute.
